Filament Fusion – Terms and Conditions

1. Agreement

a. Your usage of the Filament Fusion website (the “Site”) is subject to your compliance with the terms and conditions set forth below. If you do not agree to these Terms of Use, do not use the Site.

b. Filament Fusion may modify these terms and conditions at any time, and such modifications shall be effective immediately upon posting of the modified version on the Site. Your continued use of the Site shall be deemed your conclusive acceptance of the modified terms and conditions. However, contracts concluded on the basis of previous terms and conditions remain unaffected, but you must prove the terms which are applicable.

c. Orders placed by you are accepted, and all contracts are made subject to these terms and conditions, which shall prevail and be effective notwithstanding any variations or additions contained in any order or other document submitted by you. No modification of these terms shall be binding upon Filament Fusion unless made in writing by an authorised representative of Filament Fusion.

d. By using the services provided by Filament Fusion, you acknowledge and agree to the terms outlined in this document. These terms constitute a legally binding agreement between you and FFilament Fusion. If you do not agree with any of these terms, please refrain from using our services.

2. Usage of the Service

a. Filament Fusion offers the service of creating your design. You can use the services provided that you are of legal age to make a binding contract. If you choose to work with our services using an account, it will be protected by a password.

b. You are responsible for maintaining the confidentiality of your account password, and you are responsible for all actions taken under your account. You will immediately inform Filament Fusion in case of unauthorized use of your account. Filament Fusion cannot and will not be liable for any loss or damage arising from your failure to protect your account and/or password.

c. You are solely responsible for:

Providing true, accurate, current, and complete information about yourself as prompted in the Site account details section.
Maintaining and promptly updating account information to ensure its accuracy, currency, and completeness.

3. Ordering Process

a. The ordering process is as follows:

You upload or select the model you would like to be reproduced by Filament Fusion.
You choose the material, colour, surface finish, and size of the model (please note that the thickness must be sufficient; instructions are provided during the ordering process).
You select the country where the model must be delivered.
You review the order and costs (production, delivery, and other taxes when applicable).
You choose the payment method, execute the payment, and confirm the order.
Before paying, you have the option to go back in the process (by clicking the “back” button) if you notice a mistake and wish to modify it.

b. You must ensure that the information you submit in your order is accurate and complete before payment, as production begins immediately after payment. Modifications will only be allowed if agreed upon in writing by Filament Fusion.

c. When you place an order, you make an offer to us to buy a product. After you have placed an order, we will send you an email confirming your order details. This confirmation means that a binding agreement exists between us, unless your offer is based on a file containing two or more “grouped models” or if there is an inability to process the order, which you will be informed of within two working days.

d. Filament Fusion may, at any time during the quotation, ordering, or manufacturing process, revoke or cancel any quotation or order for technical reasons. In such cases, Filament Fusion will reimburse you for all monies paid.

e. Filament Fusion reserves the right to refuse any order that conflicts with its mission and values. This includes, but is not limited to, orders for firearms, their components, or any other items deemed unethical or unsafe.

f. You expressly acknowledge that Filament Fusion is not a medical professional. Products ordered must not be used for the diagnosis, treatment of disease, or in surgery.

g. Prices are calculated based on the requested material, surface finish, and quantity. Due to technical limitations, certain models may not be producible as requested. In such cases, Filament Fusion will contact you and may adjust the order (e.g., modify the price, delivery terms, or production technique).

h. Filament Fusion will not share your uploaded design file with third parties unless required for production. Any third party involved will be bound by confidentiality agreements.

i. Filament Fusion maintains records of orders and allows you access to them indefinitely. We recommend keeping a printed copy of these terms, your order confirmation, and invoice.

4. Price and Payment

a. The price calculated by Filament Fusion includes the cost of services, manufacturing, and shipping, as well as applicable taxes. Insurance is not included. Additional duties or taxes for delivery will be your responsibility.

b. Prices are calculated in AUD. Offsetting against non-approved counterclaims or retaining goods is excluded unless established in court, undisputed, or recognised by Filament Fusion. Filament Fusion retains ownership of products until full payment is received.

c. Separate parts of a quote may be invoiced separately. Filament Fusion reserves the right to halt further work on a quote or order if outstanding invoices remain unpaid.

5. Delivery and Risk

a. The average production time is 3 working days, but this is not binding. Delivery times depend on factors such as material availability and workload.

b. If your payment details are incorrect, delivery will be postponed until correct information is provided.

c. Filament Fusion selects reputable carriers for delivery. All transport risks are borne by you.

6. Inspection, Returns, Replacements, and Refunds

a. Due to the custom nature of 3D printing, there is no right to return or cancel orders.

b. Upon delivery, inspect the product thoroughly. If the product does not conform to the order, contact us within 14 days of receipt. Failure to inspect or use a non-conforming product releases Filament Fusion from liability.

c. Do not return products without explicit instructions from Filament Fusion.

d. Filament Fusion reserves the right to revoke or modify quotes or orders for technical reasons. Liability is limited to the price of the product directly related to the claim.

e. Internet communications may be subject to errors. Filament Fusion is not responsible for changes made to communications after dispatch.

7. Intellectual Property

a. Filament Fusion grants you a limited, non-exclusive license to generate quotes and place orders. All intellectual property rights to the Site remain with Filament Fusion.

b. The Filament Fusion website contains trademarks and brand names owned by Filament Fusion. These may not be used without written permission.

c. You are solely responsible for ensuring that your uploaded content does not infringe third-party intellectual property rights. By submitting an order, you confirm that you own or have obtained the necessary rights for production.

d. Filament Fusion is not liable for errors, malfunctions, or damages resulting from the use of electronic communications or databases.

8. Confidentiality

a. Filament Fusion treats your 3D files as strictly confidential and will not share them with third parties unless required for production.

b. By submitting a design for a contest or challenge, you grant Filament Fusion a non-exclusive, royalty-free, worldwide license to display and reproduce the design for marketing purposes.

9. Limitation of Liability

a. Filament Fusion is not liable for direct or indirect damages, injuries, or losses arising from the use of our services.

b. You assume full responsibility for the safety and suitability of printed objects for their intended use.

10. Data Protection and Privacy

a. By submitting orders, you consent to the processing of your personal data for order fulfillment and legal obligations.

b. Filament Fusion may share personal data with affiliates or third parties only as necessary to provide services or comply with legal obligations.
